All OCs and their members are bound by the ‘Model Rules’, and some will also have their own, tailored ‘Registered Rules’ lodged with the Plan of Subdivision.
Rules can include restrictions on how common property is used, the external appearance of lots and the behaviour of residents. According to the OC Act, rules cannot be ‘harsh, unconscionable or oppressive’ and must be designed to protect the ‘peaceful enjoyment’ and health & safety of residents. They must also be consistent with other laws.
This can be a hard concept to grasp, particularly for those who are used to standalone living, but ultimately, rules in an OC promote a harmonious community and ensure all residents are able to enjoy their home and maximise its value.
Remember, not being aware of the rules of your OC is not an excuse for not following them, so it’s in your best interest to be aware of what they are to avoid potential conflict and breaches. If you have a tenant, it’s best to provide them with the rules also, as you as the owner will be brought into complaint proceedings, should they arise.
